Title

[D8239ZAY], Legal Decision, Shelford Bidwell, April 21st, 1882

Editor's Notes

Copy of Bidwell's opinion about disclaimers for various TAE british pats., as requested by Dyer and J H Johnson, and with reference to views given by JHJohnson and in Dyer's 'Digest.'. In general, he recommends excising claims of dubious validitity or utility so as to strengthen each patent. Nos. 1, 2, 3 (4226, 4502, 5306 of 1878) of no practical value. No. 4 (2402 of 1879)- not much useful in this pat but discusses various amending and excising various claims; refers to TAEs opinions expressed in letters of 820306, 820213. Doesn't agree that Swan infringes claim 13 by heating clamps to remove occluded gases. No. 5: don't alter, though some doubt about claims 2 & 3. No. 6 (5127 of 1879): don't alter. No. 7 (33 of 1880) leave unaltered. No. 8 (578 of 1880) various specific recommendations. No. 9 (602 of 1880) almost wholly anticipated so leave alone. No. 10 (1385 of 1880) various specific recommendations. No. 11 (3765 of 1880) various recommendations. No. 12 (3880 of 1880--distribution system) marginally patentable but of "extremel value" if sustainable, so cut out more doubtful claims. Quotes at length TAE's 820306 letter insisting on this as most valuable patent but Bidwell repeats his doubts that any part of it is patentable. No. 14 (3964 of 1880) the usual. No. 15 (4391 1880) no value. No. 16 (1539 of 1881) trivial inventions; leave as is. No. 17 (562-1881). the usual; diverging opinions. No. 18 (768 of 1881). "This patent is of immediate imporance." Recommends cutting 3 of 4 claims. No. 19 (792 (1881) sloppy but leave alone. No. 20 (1016 of 1881) Fairly trivial; leave alone. No. 21 (1240 of 1881) Very important; too many claims but can leave alone. No. 22 (1783 of 1881) discrepancy bet provisional and full. In accordance with forgoing recommendations, have altered specifications 8, 10, 12, 14, 18.
