re patents. Handwritten correction. Dyer and Seely forwarded to you final powers for Cases 86 and 87. I sent D & S your letter to me date Sept 7th re patents, and they commented: 'From this letter the Colonel would appear to have a wrong idea as to what the point is about patents in short term countries. He says it is safe to file short term countries after all the long terms have been filed. Of course he is wrong in this, since the law in the United States limits a patent to the term of the prior foreign patent having the shortest term, not to that of the earliest foreign patent, which we imagine must be Gouraud's idea. The relative dates of the prior foreign patents have nothing whatever to do with the matter.' # You will see Dyer & Seely misunderstood your explanation and did not grasp that you had overlooked American patents entirely. # The two Portuguese patents [handwriting begins] which you took out in connection [handwriting ends] with Cases 84 and 85 limit our patents in this country in the same connection to a life co-equal with the Portuguese patents. # You applied for two ten year patents in Russia on cases 84 and 85. You do not state whether you make any effort to keep these patents from issuing. Take immediate steps to prevent them from coming out until advised that they can be issued without prejudice to any of my American patents.
