New York, October 4, 1901 Thomas A. Edison, Esq., Orange, N.J. Dear Sir,- We beg to enclose (a) an original affidavit for your signature in the application on the cadmium copper battery, (b) a carbon copy of an affidavit which Mr. Rafn has already signed for use in the same case, and (c) a carbon copy of a proposed amendment and argument in the application. If you find that the affidavit prepared for your signature is correct and that Mr. Rafn’s affidavit embodies your views, kindly execute the former as we have indicated. You will note that the claims which we have prepared are very broad in scope, the first four not being limited to an alkaline electrolyte, but claiming any solution “which remains unchanged during all conditions of working”; claims 10, 11, 12, 14 and 15 are broad enough to cover the nickel iron battery, because each of these because each of these claims specifies a depolarizing material which is electrolytically reducible to the metallic state. After you have executed the affidavit as indicated, kindly return all the papers to us. Yours truly,
