re separating the magnetic iron ores of your Company I propose the following: # I will design and have constructed and shipped to Port Henry, NY, one or more Magnetic Separators of a design similar to the one in place at Orange, NJ, you to have the apparatus erected in the suitable building; the details of such erection to be subject to my approval and inspection. The cost of the manufacture and installation to be borne by your Company. # Your Company are to provide all crushers, rolls, screws &c. for proper reduction and sizing of the ore reading for the hopper of the Magnetic Separator. Apparatus to be started by and operated by my representative, who shall not be detained for more than a month. If required longer, you are to pay him for his time and board; if not over a month no compensation to be made for his services. # For all separated ore ready for shipment your Company is to pay me a royalty of ten cents per ton, of 2,240 lbs., in quarterly installments. In view of establishing the initial plant I agree that if royalties are reduced to or below 10 cents per ton, then your Company shall from the time of such reduction pay but 80 percent of the price charged any other producer of separated magnetic iron ore. # Payment of royalties to commence from the time that the experimental test under the charge of my assistant is terminated. # The number of Magnetic Separators is not restricted, but Witherbees, Sherman & Co. can use as many Magnetic Separators as required for the mines they operate.
