Dear Sir:- 
Mr. J. W. Mackintosh, who was and is still I believe President of the Edison Phonograph Toy Manufacturing Company, called to see me on the Saturday last in regard to the litigation which is pending between that Company and the Edison Phonograph Works. In the course of conversation Mr. Mackintosh informed me that he personally had obtained from the graphophone people the right to use their patents in connection with a speaking doll, and that us was his intention to go into this business under the said patents. It has occurred to me in this connection to inquire if the North Am. Phonograph Co. ever served notice upon the Edison Phonograph Toy Co. to the termination of their license agreement for non-payment of minimum guarantee. If this has not been done I think it should receive immediate attention, as it is very probable that complications will arise are long. I would suggest that you examine not only the agreements between the N.A.P. Co, and the Toy Company, but also the agreements between the Toy Company and the Edison Phonograph Company. Major Eaton has a full set of these and you could obtain copies from his office. I do not know whether there is more than one agreement in either case, but this information you can also get from Major Eaton’s office.
