Automatic Phonograph Exhibition Co.
[Illegible]
Gentlemen: -
The several applications of [illegible]… by this Company and now in the Patent Office, held up by a requirement of the Examiner that Mr. Keller [illegible]… showing the completion of his invention before the fate of certain patents which issued here or prior to the date of his applications. Mr. Keller set forth such facts [illegible] in a disposition taken some months ago in the [illegible] in which his applications were involved but the Examiner refuses to accept this disposition as the equivalent of an affidavit found in the case. Mr. Keller is very hard to handle, but I have several [illegible] paper from him through the aid of Mr. E. T Gilliland. But Mr. [illegible] is now in Adrian, Michigan, and Mr. Gilliland no longer has an office in town. And aside from the inconvenience involved, I do not feel [illegible] using my social acquaintance with Mr. Gilliland to his annoyance to ask in the prosecution of the cases.
My own desire therefore is that an appeal is taken from the examiner’s requirement, with the aim of obtaining an order commissioner directing this examiner to accept certified copies of the deposition in lieu of the affidavit required. Such an appeal is now pending.
Thinking that perhaps some officer of the Company [illegible] be able to get from Mr. Keller the paper desired, or that the Company may desire to determine the tier and manner of prosecution of the applications, I wrote nearly two months ago asking a conference with one of the officers. This letter was received but has not been answered.
I do not wish to involve the Company in expense when not in touch with its managers, and therefore write to learn whether the company wishes to have the applications prosecuted vigorously or not, and whether any or the officers can render any assistance by obtaining papers from Mr. Keller.
There is also an interference pending between an application of John Ott and one of Gilliland and Toppan. I have tried several times to have this matter closed up, but have not been able to have the necessary attention paid to it by the Company. It is probably not important which application wins, but the interference might as well be closed up.
An early and full reply will be appreciated.
