"I want agreement between TAE -- and Lowell C Briggs & William W Jacques both of Boston as follows ## 1st Exclusive because to make and sell phonograph Dolls and figures, & not phonographs ## 2nd Royalty to be 10 per cent on the selling price of the Doll or figure whether retailed or wholesaled -- legitimate way -- ## 3rd Clocks are excepted -- ## 4th They are to have the right to sell in any foreign countries, royalties to be the same, where there are patents ## 5th Royalties acruing to Edison for first nine 9 months to be not less than $4000, and the contract is thereafter to continue providing that in each year the royalties paid Edison shall not be less than $10,000 per year ## Edison to sue the first infringer of toy phonographic apparatus in N York City but not in any other city or state ie make one test case -- usual clauses about sworn statement access to books acknowledge validity patent, bonifide sales etc."
