Thomas A. Edison, Esq.,
Dear Sir:
Re Lippincott. You asked me whether you need pay any attention to the citation enclosed herewith, served on all the Creditors of Lippincott, yourself included, to appear in Court on the 25th inst. for the purpose of objecting, if they wish, to Lippincott’s claim against the N. A. P. Co., being compromised as follows to wit: by adjusting his claim at $43,146.18, and by his accepting in payment thereof $43,000 of the Debenture Bonds of the N.A.P. Co. plus $146.18 in cash.
My understanding is that you do not object to this settlement, so there is no need of your paying any attention at all to the citation.
I have just read over the long Petition of the Assignee wait, praying the Court that this matter may be adjusted as above, and I notice that Mr. Wait states that you have agreed that so far as you have power you will consent to a cancellation of Lippincott’s Bond for $175,000, which you hold touching the section action of Edison vs Gilliland and Tomlinson. The fact that Mr. Wait states this (he does it by direction of Mr. Bush, no doubt) does not bind you, nor, are you called upon either to affirm or to deny it. I merely mention the matter in order to let you know what is going on.
Very truly yours,
[Signed] [Page 2 from the Court of Common Pleas to Jesse H. Lippincott to Frederic S. Wait. It is a citation.] The People of the State of New York
To all persons interested in the estate of JESSE H. LIPPINCOTT, assigned to Fredrick S. Wait for the benefit of creditors:
YOU, AND EACH OF YOU ARE HEREBY CITED and required to appear before and in the Court of Common Pleas for the City and County of New York, at a Special Term to be held at the Chambers thereof, in the County Court House, New York City, on the 25th day of July, 1892 at 10:30 o’clock in the forenoon of that day, or as soon thereafter as counsel can be heard, then and there to show cause why the account of said Jesse J. Lippincott with the North American Phonograph Company should not be adjusted, stated, settled and compromised as set forth in the petition of said Frederick S. Wait, filed in the office of the Clerk of Court of Common Pleas on July 7th, 1892, and why said Fredrick S. Wait should not have such other or further order or decree as may seem just in the premises.
In testimony whereof, I have caused the seal of the Court of Common Pleas for the City and County of New York to be hereunto affixed the 7th day of July, 1892.
Witness Hon. Henry Bishoff, Jr., Judge of the Court of Common Pleas for the City and County of New York.
[SEAL]
ALRED WAGSTAFF,
Clerk.
