[LB034061], Letter from Alfred Ord Tate to Albert Blake Dick, October 30th, 1889

["COPY"] "I am very much obliged for your letter of 28th inst., in regard to Mr. Edison's royalties on mimeographs sold abroad. I understood before interrogating you in this matter that Mr. Edison had no rights in the shape of patents to transfer to your Company, but that is a matter which does not enter into a consideration of the relations between Mr. Edison and yourselves. The agreement between Thomas A. Edison and the A.B. Dick Company, under date 27th day of June 1887, in the first section provides: 'The Party of the first part (Edison) hereby grants and hereby licenses and empowers the party of the second part and its successors and assigns, the sole and exclusive right for the term hereinafter stated, to manufacture and to grant to others the right to manufacture, subject to the conditions hereinafter named, apparatus for preparing Autographic Stencils for printing, as covered by said Letters Patent, and to sell and grant to others the right to sell the same within the United States, but not for export to other countries.' ### It would appear from this that the limitation of your business to the United States is one of the conditions of the grant of your original license, and that this condition is at the present time being violated by your Company. ### I would have pointed this out in my previous letter to you, but the same was written without reference on my part to the contract between your Company and Mr. Edison. It is a matter which you yourself have apparently overlooked, and I call your attention particularly to it, for the reason that it seems to me to be very important interests which you represent that your business should be conducted in accordance with the existing records of the rights possessed by the A.B. Dick Company. Very truly yours, A.O. Tate
