My dear Sir,
The Edison Phonograph Works is, as you are aware, preparing a statement of [illegible text] against the North American Phono. Co. which will be mad up in accordance with contract as interpreted in behalf of the Works. I presume there is no doubt that this construction of the agreement will be disputed, in view of which I would suggest that you obtain a copy of the proceedings of the North Am. Phono. Co. in regard to tax levied upon their Capital by the State of New Jersey.
It is quite probable that some of the evidence taken in this connection will assist in sustaining the position which the the Works intend to assume. I myself testified for the works and I had in mind the probability of affairs assuming the shape they have now taken — and expressed myself accordingly. If the N.A.P. Co. confirmed my statements by any subsequent act I am sure the record would be useful to us. It is possible too that some of the N.A.P. Co officials may have committed themselves.
